Terms and condition of legal work based on the declaration

Note!

  • The declaration on the intention to entrust a job provides a basis for legal work only on terms set in the declaration.
  • The declaration is not a contract, and thus concluding a written contract is necessary. It has to include the same terms and conditions as set in the declaration.
  • Having visa for the purposes of performing work does not provide for the possibility of unlimited legal employment in Poland.
  • The contract between the employer and the employee can be signed not before the declaration on the intention to entrust a job is registered.
  • Work performed by a foreign without a contract signed is illegal in accordance with the Polish law.
  • If changing the contract type or position is planned, a new declaration needs to be registered.
  • If a foreigner would like to change the employer, the new employer needs to register the declaration.
