Grounds for legal residence and legal work
The fundamental condition of legal work is legal residence in Poland. Check your documents to make sure you are authorised to perform work in Poland.
Note!
Polish visas issued for the following purposes do not authorise the holder to perform work even if he has a work permit or an employer’s declaration of the intention to entrust work to him:
- Purpose: 01 – when the visa was issued for the purpose of tourism (article 60 section 1 point 1 of the Act of 12 December 2013 on foreigners);
- Purpose: 22 - when the visa was issued for the purpose of temporary protection (article 60 section 1 point 22 of the Act of 12 December 2013 on foreigners);
- Purpose: 23 - when the visa was issued for humanitarian reasons, due to the interest of the state or international commitments (article 60 section 1 point 23 of the Act of 12 December 2013 on foreigners).

What is important is that every visa or residence card issued by the authorities of another Schengen Area country, combined with a work permit or a declaration of the intention to entrust work to a foreigner authorise him to perform work within the territory of Poland. It should only be kept in mind that on the basis of such a visa one may reside in Poland for no longer than 90 days.
